Kynismos AI Terms and Conditions

These Terms and Conditions ("Terms") govern the use of the presale program and subscription services provided by Kynismos AI ("Company", "we", "us", or "our"). By participating in the presale and subscribing to our services, you agree to these Terms.
1. Presale Program
Presale Offer Details:
- Presale Price: Users who participate in the presale program (Founder’s Edition) will lock in a special rate of $15/month for the "Professional" level service (Standard price of $30/month). This discounted rate will apply for the entire first year of the subscription.
- Presale Payment: Users will prepay for the first month of their subscription during the presale, which will be applied to their first month of service once the product is live.
2. Refund Policy
- Non-Refundable Before Launch: Prepayment for the first month is non-refundable, except under specific conditions outlined below.
- Refund Conditions: Users may request a refund if:
- The product does not launch at all.
- The product launch is delayed by more than six months beyond the expected launch date (which is currently estimated to be July 1st, 2025).
3. Service Availability and Delays
Product Launch Delays: We do not commit to notifying users about delays. However, if the product has not launched within six months of the expected launch date, users can request a refund as described above.
4. Subscription Terms
- Subscription Period: The initial subscription period is one year beginning from the product launch date.
- Automatic Renewal: After the first year, your subscription will automatically renew at a new Professional rate (to be determined prior to billing). We will notify you three times before your renewal date, giving you the option to review, upgrade, downgrade, or cancel your subscription.
- Billing Cycle: Recurring billing will begin on the second month after the product goes live.
5. Payment Terms
- Initial Payment: The first month’s subscription payment will be processed through Stripe during the presale period. This payment will be applied to the first month of service once the product is live.
- Recurring Billing: Recurring payments for the subscription will begin on the second month after the product is live and will be processed through Stripe. Additional forms of payment may be available at this time.
- Payment Method: Payments will be processed via Stripe using the payment method you provide during checkout. You may update your payment method at any time via your account settings.
6. Data Privacy and Security
- Data Collection: We collect personal information, including **your name, email address, payment details, and other necessary data to process your subscription and provide our services.
- How We Use Your Information: Your personal information will be used solely for processing your subscription, delivering our services, and sending important product updates. We will never share your personal information with third parties unless required by law.
- Security Protocols: We take appropriate measures to protect your data, including encryption for payment processing through Stripe. However, no method of electronic transmission or storage is 100% secure, and while we strive to use high-performing means to protect your information, we cannot guarantee its absolute security.

7. User Obligations and Restrictions
Prohibited Activities: Users agree not to:
- Share account credentials with others or use the service in an unauthorized manner.
- Attempt to reverse-engineer, modify, or access our service's source code.
- Use the service for unlawful purposes or activities that violate applicable local, state, or international laws.
Acceptable Use: Users are expected to use the service in good faith and in accordance with these Terms, ensuring that their actions do not disrupt, damage, or interfere with the operations of the platform.
8. Limitation of Liability
To the maximum extent permitted by law, Kynismos AI will not be liable for any indirect, incidental, special, or consequential damages arising out of or related to your use of the service, including but not limited to damages for lost profits, loss of data, or interruption of service.
9. Indemnification
You agree to indemnify, defend, and hold harmless Kynismos AI, its affiliates, officers, employees, and agents from any claims, damages, liabilities, or expenses (including legal fees) arising out of or related to your use of the service or violation of these Terms.
10. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles. Any disputes arising from these Terms will be resolved in the courts located in Wilmington, Delaware.
11. Modifications to Terms
Kynismos AI reserves the right to modify or update these Terms at any time. We will notify users of significant changes via email or through a notification on our platform. By continuing to use the service after any changes to these Terms, you agree to the updated Terms.
